If your application has been refused and you have been given appeal papers you may contact us to discuss how we can advise and assist you in submitting your appeal and progressing the appeal proceedings through the Tribunal system. We know that having your applications refused causes much worry and anxiety about your future in the United Kingdom. Through instructing us you will be tapping into our experience gathered over the years and the expertise in dealing with appeals. You may rest assured that with your continued assistance, we shall do our best to see that you succeed in your appeal.
Our fee structure is competitive and transparent. We shall let you know from the outset how we shall progress your appeal and the fees we shall charge for each stage, so that there will be no hidden costs and surprises involved.
From the time you instruct us to deal with your appeal; we will commence the work to be done relating to your appeal. This will include advising you on the evidence required to prove your case, preparation of witness statements including the appellant’s witness statement and those of any witnesses who wish to support your application by giving evidence at the tribunal hearing. In most cases, after obtaining your instructions we prepare a chronology (events relating to the application in date order) which will be a reference item for you as well as assisting the immigration judge.
There is a strict timeline to be adhered to in an appeal and this will include the date by which you should submit your evidence to the Tribunal. Usually this should be done 5 working days before the hearing and we shall prepare bundles containing evidence such as witness statements, country evidence, documents, photos and other information relating to your matter and submit them to the Tribunal within the specified time limits. Copies of the bundles need to be served on the Home Office Presenting Officers Unit that deals with the particular Tribunal.
You will be represented at the Tribunal by Counsel (barrister) who have expertise and experience in representing cases such as yours at the Tribunals. Our fee for an appeal will usually cover one conference with Counsel at the Tribunal premises before the hearing. If your case carries complex issues and if you or your representative (if you are appealing from abroad) reside in the UK we advise you to see Counsel well in advance of the hearing so that he/she can discuss your case with you and able to guide you on any strategic issues. This may incur additional fees.
We shall advise you, assist you and guide you through the appeals process and at each stage we shall let you know the merits, success rate of any further application/appeals to the Upper Tribunals etc. and if any further applications/appeals can be made we shall let you know of the likely costs.
